SWK4103 Politics and Law in Australia

Description:
This unit provides students with the opportunity to explore the political and legal context of social work practice in contemporary Australia, with specific reference to rural, regional and remote issues. Students will firstly develop an understanding of the political system in Australia, including a detailed account of the structure of government (federal, state and local) and the differing legislative responsibilities, with reference to the Constitution. It will also explore the notion of democracy (and other political systems), parliament and the political process in Australia. The second part of the unit will examine the legal system in Australia including an overview of how legislation is made and the various legal apparatus including the courts, tribunals and other quasi-judicial decision making bodies. The unit will also discuss the interaction between the political and legal systems. This unit will critically examine the influence of law and politics on social work practice, identify core values and philosophy underpinning the political and legal systems and explore such concepts as social justice, natural justice and human rights. It will also examine the role of law reform and the relationship between politics, the law and social policy.
