Civil Procedures 2 builds upon the framework of knowledge developed in Civil Procedure 1 with a deeper coverage of those orders enabling interlocutory processes, particularly injunctions and freezing orders, discovery and inspection and the use of subpoenas. The key authorities interpreting those will be explored. The procedure at trial, the use of experts, judgment (including execution), appeals and costs will be covered. as will the administrative remedies of the State Administrative Tribunal and the probate jurisdiction of the Supreme court. The unit will touch upon the procedures of the Court of Appeal. In Civil Procedures 2 the practical application and ramifications of the rules will be illustrated through tutorial exercises. To demonstrate their understanding of the rules, students will draft basic affidavits, submissions for interlocutory hearings and advices on interlocutory procedural issues. Full Unit Outline | |||
