LAW2313 Administrative Law II

Description:

This unit is concerned with remedies available to parties who succeed in establishing a ground of judicial review (prerogative writs, mandamus, certiorari and prohibition; declarations and injunction). Statutory restrictions on judicial review will be covered. The unit examines federal administrative law under the Administrative Decisions (Judicial Review) Act 1977 (Cth) and statutory regimes for the Administrative Appeals Tribunal, the Social Security Appeals Tribunal, the Migration Review Tribunal and the Refugee Appeal Tribunal.

 

The unit also undertakes an analysis of freedom of information legislation with particular reference to the concepts of open government and transparent decision making.
