LAW2103 Administrative Law I

Description:

Administrative law is concerned with the causes of action and remedies available to a citizen when disadvantaged by an unfair administrative decision. This unit addresses the key aspects of judicial review in WA, including denial of natural justice, ultra vires, jurisdictional error and error of law on the face of the record.

 

The unit also addresses constitutional issues including the sovereignty of parliament and delegated legislation, and devotes considerable time to the policy reasons for the doctrine of the separation of powers.

 

Modern controversies including the boundary between merits review and judicial review, the role of discretion in decision making and standing to sue will also be covered in detail.
