This unit opens with a discussion of the history of contract law (contracts under seal, assumpsit and debt) and then moves on to examine the modern law of contract based on promissory liability including aspects such as offer and acceptance, intention to create legal relations, the doctrine of consideration, promissory estoppel, certainty of terms and formalities of contract. A significant amount of the course will also be devoted to identifying and construing the terms of a contract.
The course covers how and when a terms of a contract are implied and when a person who is not party to the contract can sue on it (privity).The requirement of parties to perform their contractual obligations in good faith will also feature in the course. . Full Unit Outline | |||
