Description:

Civil Procedures 1 and 2 together provide a detailed review of the rules for the conduct of civil litigation in Western Australia and the law relating to interpretation and application of those rules.  The Rules of the Supreme Court 1971 (WA) will be considered in detail as will authorities dealing with their interpretation.  The rules of other state courts and the rules of the Federal Court of Australia and Federal Magistrates Court will also be touched upon.  In Civil Procedures 1 the practical application and ramifications of the rules from the commencement of proceedings to disposition pre-trial will be illustrated through tutorial exercises.  To demonstrate their understanding of the rules, students will draft basic pleadings and particulars.
