LAW4604 Civil Procedures I

Description:

This unit involves a detailed review of the rules for the conduct of civil litigation in Western Australia, in a federal court, the Supreme Court, the District Court and Local Court, as well as the State Administrative Tribunal, from commencement of proceedings in the appropriate jurisdiction to the disposition of pre-trial proceedings.  The Rules of the Supreme Court 1971 (WA) will be considered in detail.  Students will be involved in practical exercises through drafting pleadings and particulars, as well as a practical understanding of case flow management principles.  In addition, alternatives to civil litigation will be considered. Lawyers' professional obligations will also be examined in the context of civil court proceedings.
